This AGREEMENT is made between Kim Anderson Consulting, LLC (“KAC”), 222 W Warren St. Shelby, NC 28150 and you (“Client”), at the address provided at checkout.
By purchasing a Kim Anderson Consulting, LLC service (coaching and/or in-person retreat) Client is agreeing to abide by these terms.
MASTERMIND GROUP
Payment:
All coaching packages, mastermind groups and in-person retreats and sessions are paid for in advance. Billing preferences can be updated by logging into Acuity.com. If the Client opts for a payment plan option and has any payment processing issues, they should be dealt with within 5 days of notification to avoid cancellation of coaching or retreat spots.
Coaching Calls, Emails, and Communication
Kim can make time available leading up to the retreat or between coaching sessions to communicate with Client. All communications should be sent via email to Kim@KimAndersonConsulting.com and not through text or instant messenger programs.
MENTORED MASTERMIND TERMS:
Mentored Mastermind Sessions:
All Mentored Mastermind Sessions are 60-75 minutes in duration on a weekly basis for the agreed-upon term of time. It is each member’s job to attend the meetings. It’s perfectly acceptable to miss meetings when necessary but note that there are no recordings or playback of the group calls and the meetings. There are no make-up meetings.
Payment:
All Mentored Membership dues are paid for using Stripe through Acuity.com scheduling. Billing preferences can be updated by logging into Acuity.com. If Client opts for a payment plan option and has any payment processing issues, they should be dealt with within 5 days of notification to avoid cancellation mastermind spots. Mentored Membership dues ($99) are automatically processed on around the day of the month that members paid for their full registration for 3 payments of $99.
Coaching Calls, Emails and Communication
During the Mentored Mastermind sessions, current group members have a priority. All communications should be sent via email to Kim@KimAndersonConsulting.com and not through text or instant messenger programs.
Termination of agreement & refund policy:
All mastermind groups are a 12 Week commitment and non-refundable once payment has processed (should a client terminate our agreement for whatever reason). If a client leaves the group with more future payments to process in the future, we will cancel future payments. We reserve the right to terminate our agreement and cancel a Mentored Mastermind members participation without refund or explanation should a client or member manifest hostile, aggressive, inappropriate, discriminatory or violent behavior.
Liability Responsibility
Client is responsible their own application, implementation and decisions when using KAC for coaching. KAC will offer suggestions, options, and coaching, based on online business and professional experience, and will work with Client to identify solutions to problems, but any decision about a course of action is the Clients, and Client accepts full responsibility for such decisions. Clients should carefully evaluate the consequences of various options, and decide accordingly. KAC makes no representation, or warranty to you that any of the coaching methods, courses, retreats, sessions, or activities will work for your particular circumstances and in no way guarantee any results.
Agreement not to Hold Liable & Indemnity.
You acknowledge that the Coaching Sessions and retreats may be personally, emotionally, and mentally challenging and that there may be occasions on which Client will feel such challenges including, but not limited to, frustration, anger, annoyance, and stress. Client will not hold KAC, mastermind group members or other retreat mentors liable for any loss or cost incurred by Client (or any person related to or associated with Client, including but not limited to Client’s customers) in the event of mental, physical, financial, emotional stress, or distress (or other ailment or condition) caused either directly or indirectly in relation to the Coaching Sessions, Mastermind Meetings or retreat presentations.
You shall indemnify Kim Anderson Consulting, LLC and Kim Anderson in the event of any such claim, including but not limited to any claims made against KAC by any person related to or associated with Client, including but not limited to Client customers. Anything said by an employee, partner or representative of KAC or a retreat mentor, verbally or in writing, shall not be constituted to be advice of any kind, including, but not limited to, medical, psychological, legal, financial, counseling, business, or actuarial advice. Client agrees that Kim Anderson nor Kim Anderson Consulting LLC nor the retreat mentors shall not be liable to Client in any way, and Client shall indemnify and save KAC, Kim Anderson and it’s representatives harmless for any and all losses or costs incurred by Client or any other person, including but not limited to Client’s customers, for any action or inaction taken by Client or anyone else as a result of the Coaching Sessions, Mastermind Meetings retreats or any other conversations Client and KAC employees or representatives have, whether by meeting, texts, email, telephone, Zoom, Facebook Messenger, Facebook groups, social media or otherwise. KAC reserves the right to terminate sessions immediately, and without prior notice, if KAC believes it’s employees or representatives can’t be of help to you.
Law & Venue
This Agreement shall be governed by and construed in accordance with North Carolina law. In the event litigation is necessary to enforce this Agreement, venue shall be proper in any court of competent jurisdiction located in Cleveland County, North Carolina.
